(1) The right of mortgage can be created in connected goods. If the right of lien is attached to the goods after the creation, the right of lien shall continue. (2) Notwithstanding anything written in sub-section (1), the right of lien on general construction materials shall be terminated when such materials are included in the immovable property. (3) Easily removed or withdrawn. The priority of finished factory machines, office machines or household goods shall not be determined in accordance with this section. (4) Except as otherwise provided in this section, the right of mortgage over the attached goods shall be subordinated to all other real rights in the immovable property. If the notice is registered before registration in accordance with the law, the right of the matured mortgage on the attached goods shall have priority over the rights of the owner of such immovable property or the rights of the mortgagee regardless of what provision is made in the mortgage deed. The right of matured mortgage shall have priority over the lien holder's right. (7) If the right of mortgage given by the mortgagor before the goods are attached is the right of mortgage related to the purchase price and if the notice is registered before such goods are attached or within five days from the date of the attached goods, the matured mortgage on the attached goods The right shall have priority over the right of the owner of the immovable property, the lienholder or the mortgagee notwithstanding any provision in the deed of mortgage. But the priority so determined shall not apply to construction liens. Explanation: For the purpose of this sub-section, "construction lien" means any payment for construction improvements made to immovable property. (8) If the secured obligation is not fulfilled, the person taking the mortgage who gets priority under this section may separate the goods attached to the immovable property in the following manner as follows:- (a) LandThe mortgagor who takes away the goods must immediately submit to the mortgagee other than the mortgagor the cost of repairing the damage caused to the immovable property, (b) due to the lack of the goods to be removed by the mortgagor or the need to replace such goods at the value of such immovable property Due to the deficiency, the person taking the mortgage or the owner must pay the amount, and (c) the person receiving the mortgage can refuse to give permission to remove such connected goods unless he can give sufficient confidence that the person taking the mortgage will fulfill the obligation to pay the deposit.
